Jonesin’ Delightz – Terms & Conditions

1. Order Agreement

By placing an order with Jonesin’ Delightz, you acknowledge that you have read, understood, and agree to all terms outlined below. These terms apply to all products and services, including cakes, cake jars, desserts, and event orders.

 

2. Cottage Food Operation Disclosure 

By placing an order with Jonesin’ Delightz, you acknowledge that you have read, understood, and agree to all terms outlined below. These terms apply to all products and services, including cakes, cake jars, desserts, and event orders.

 

3. Retainer & Payment Policy

A 50% non-refundable “Save the Date” retainer is required to secure all custom and event orders. Orders are not confirmed until the retainer is received.

Remaining balances are due as follows:

  • Standard Orders: 2 weeks prior to service date

  • Wedding/Event Orders: 3 weeks prior to service date (unless otherwise stated)

Orders placed less than 2 weeks in advance require full payment upfront.

Payments may be made in full or in up to 3 installments, provided the balance is paid by the deadline.

No changes, reductions, or order downsizing will be permitted after final payment has been made.

 

4. Cake Tastings

Cake tastings are a separate service and are not included in any order or contract. All tasting fees are non-refundable. It is recommended that tastings be completed prior to finalizing order details.

 

5. Cancellations, Refunds & Rescheduling

All retainers are non-refundable for any reason.

Cancellations made:

  • More than 3 weeks prior to the event: Payments may be refunded minus the retainer and any incurred costs

  • Less than 3 weeks prior to the event: No refunds will be issued

No refunds will be issued after delivery or pickup.

Credits may be issued on a case-by-case basis and must be used within 30 days. Credits are non-transferable.

Rescheduling requests must be submitted as soon as possible and are subject to availability. Full payment must be completed before a new date is secured.

 

6. Cake Jars vs Custom Cakes

Cake jars are a deconstructed dessert product and are not equivalent to a traditional layered cake.

Cake jars may include layered cake pieces, fillings, and toppings within a jar format. Customers should not expect cake jars to reflect the structure, appearance, or eating experience of a traditional cake.

Refunds or complaints based on misunderstanding this difference will not be honored.

 

 

7. Design & Creative Policy

Inspiration photos are used as a reference only. Jonesin’ Delightz does not replicate designs exactly. Each order is a custom artistic interpretation.

Colors may vary due to lighting, food coloring reactions, and environmental factors.

No design or flavor changes are permitted after final payment has been received.

 

 

8. Delivery, Pickup & Responsibility

Pickup is available in Rincon, GA. Delivery is available for an additional fee.

  • 3-tier cakes require delivery

  • 2-tier cakes are recommended for delivery; pickup is at the customer’s own risk

Once the product leaves our possession or setup is completed, Jonesin’ Delightz is no longer responsible for any damages.

 

9. Cake Care & Environment Conditions

Cakes must be stored in a cool environment (70°F or below). Buttercream cakes may begin softening after approximately 2 hours at room temperature.

Cakes should not remain at room temperature longer than 4 hours before serving.

For outdoor events, cakes left outside for more than 30 minutes in warm conditions are not guaranteed against melting, structural damage, or environmental exposure.

The client is responsible for providing a stable, suitable setup area. Jonesin’ Delightz is not responsible for damage caused by improper setup, environment, or handling.

 

10. Damage & Repair Policy

Repairs, if available, will incur a $250 service fee and must be paid prior to service. Repairs are subject to availability.

 

11. Taste, Texture & Product Satisfaction

Flavor and texture are subjective. Refunds will not be issued based on personal taste or texture preferences.

All products undergo quality checks prior to completion.

 

12. Complaint & Resolution Policy

All concerns must be reported on the same day as pickup or delivery.

The following is required for review:

  • Return of uneaten product, or

  • Clear photo or video evidence

Failure to provide proper documentation may result in no resolution being offered.

 

13. Liability Waiver

Products may contain structural supports. Do not smash cakes or desserts into faces.

Jonesin’ Delightz is not responsible for injuries or damages resulting from misuse of products.

To the fullest extent permitted by law, Jonesin' Delightz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the purchase, delivery, consumption, or use of any product or service.

In any circumstance where liability is established, the maximum liability of Jonesin' Delightz shall be limited to the total amount paid by the Client for the specific order giving rise to the claim.

The Client agrees that any claim related to products or services provided by Jonesin' Delightz shall be limited exclusively to remedies outlined within these Terms & Conditions.

 

14. Acts of God / Emergencies

In the event of natural disasters, severe weather, or emergencies beyond our control, a 50% credit may be issued toward a future order within 30 days.

 

15. State of Emergency / Postponements

Events may be rescheduled within 6 months based on availability. No new retainer will be required. No refunds will be issued.

 

16. Illness Policy

If the client becomes ill, notification must be provided immediately. Orders may be rescheduled within 3 months based on availability.

If Jonesin’ Delightz is unable to fulfill an order, we will attempt to secure a replacement baker or issue a partial or full refund depending on the situation.

 

17. Allergen Disclaimer

Products may contain or come into contact with milk, eggs, wheat, soy, peanuts, tree nuts, and other common allergens.

Jonesin' Delightz does not guarantee allergen-free, gluten-free, dairy-free, nut-free, vegan, or other specialty products unless specifically agreed upon in writing.

Clients are responsible for notifying Jonesin' Delightz of any known food allergies prior to placing an order.

A complete ingredient list and allergen disclosure will be made available upon request and may be provided with applicable orders in accordance with Georgia Cottage Food regulations.

While reasonable precautions are taken to minimize cross-contact, all products are prepared in a home kitchen where allergens may be present.

 

18. Fresh Flowers & External Decorations

Fresh flowers and external decorations are the responsibility of the client or florist. Jonesin’ Delightz is not responsible for safety, contamination, or compatibility of these items

 

19. Substitution Policy

We reserve the right to substitute ingredients or decorative elements of equal or greater quality due to availability.

 

20. Photography & Marketing

We reserve the right to photograph all products for marketing and promotional use. Requests for delayed posting must be made in advance.

 

21. Dispute Resolution 

Jonesin' Delightz is committed to resolving concerns fairly, professionally, and in good faith.

In the event of a dispute arising from products or services provided by Jonesin' Delightz, the Client agrees to first notify Jonesin' Delightz in writing and allow a reasonable opportunity to review and address the concern before pursuing legal action.

Both parties agree to make a good-faith effort to resolve disputes through informal discussions and negotiation.

If a resolution cannot be reached through informal discussions, the parties agree to attempt mediation prior to initiating any lawsuit, except where prohibited by law.

Any legal action arising from services provided by Jonesin' Delightz shall be brought in the appropriate court located in Effingham County or Chatham County, Georgia, and shall be governed by the laws of the State of Georgia.

Each party shall be responsible for its own attorney's fees, court costs, and expenses unless otherwise awarded by a court of competent jurisdiction.

 

22. Non-Disparagement Clause

Clients agree to address concerns directly with Jonesin’ Delightz prior to posting public reviews. We are committed to resolving issues professionally.

 

23. Payment Methods

Accepted payment methods include debit/credit cards and approved digital payments. Checks are not accepted.

 

 

24. Final Agreement
